By registering for, accessing, or using the Aurelian platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Platform.
We reserve the right to update or modify these Terms at any time, with or without notice. Your continued use of the Platform following any changes constitutes acceptance of the revised Terms. It is your responsibility to review the Terms periodically.
To be eligible for membership, you must:
Membership is by invitation and application only. All applications are subject to review and approval at the sole and absolute discretion of the Operator. The Operator reserves the right to reject any application without providing reasons.
The Operator may, at its sole discretion and without notice, suspend, restrict, or terminate any membership for any reason or no reason at all.
Golden Credits are an internal unit of exchange used solely within the Platform. Golden Credits:
The Operator reserves the right to adjust, modify, or reset Golden Credit balances at any time and for any reason, including but not limited to corrections, system changes, or policy updates.
Upon termination of membership (whether voluntary or involuntary), all Golden Credits are immediately forfeited and extinguished without compensation.
Members who list Properties on the Platform ("Hosts") are solely responsible for the accuracy, completeness, and legality of their listings, including descriptions, photographs, availability, and pricing in Golden Credits.
The Platform does not inspect, verify, endorse, or guarantee any Property, listing, or Host. The Platform merely facilitates introductions between Members and is not a party to any agreement or arrangement between a Host and a guest.
Any agreement for a Stay is made directly between the Host and the guest Member. The Operator has no obligation or liability in respect of any such agreement.
The Operator makes no warranties, representations, or guarantees regarding the condition, safety, quality, legality, or suitability of any Property listed on the Platform.
Members stay at Properties entirely at their own risk. Members are solely responsible for:
Hosts are solely responsible for ensuring their Properties comply with all applicable local, provincial, and national laws and regulations, including health and safety requirements, zoning, and licensing.
Members agree to:
Members retain ownership of content they submit to the Platform (including photographs, descriptions, and reviews). However, by submitting content, Members grant the Operator a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, display, and distribute such content in connection with the operation and promotion of the Platform.
The Aurelian name, logo, branding, and all Platform design, code, and functionality are the exclusive property of the Operator. No Member may use, reproduce, or distribute any Operator intellectual property without prior written consent.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law:
Members agree to indemnify, defend, and hold harmless the Operator and its directors, officers, employees, agents, and affiliates from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
In the event of any dispute between Members, Members shall first attempt to resolve the dispute directly with each other.
If a dispute cannot be resolved directly, Members may request that the Operator facilitate informal mediation. The Operator is under no obligation to do so and any such facilitation shall not constitute legal advice or impose any liability on the Operator.
Any dispute arising out of or in connection with these Terms or the Platform that cannot be resolved informally shall be subject to mediation in Cape Town, South Africa, before recourse to litigation.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. The courts of Cape Town, Western Cape, shall have exclusive jurisdiction over any dispute arising from these Terms.
The Operator collects and processes personal information as necessary to operate the Platform, in accordance with the Protection of Personal Information Act, 2013 (POPIA).
By using the Platform, Members consent to the collection, processing, and storage of their personal information as required for the operation of the Platform, including but not limited to account management, communications between Members, and platform improvements.
The Operator may terminate or suspend any membership at any time, with or without cause, and with or without notice.
Members may terminate their own membership at any time by contacting the Operator.
Upon termination of membership, all Golden Credits are immediately forfeited. The Member's profile and listings will be removed from the Platform. Any pending or confirmed bookings may be cancelled at the Operator's discretion.
The Operator reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice, and without liability to any Member.
The Operator reserves the right to modify these Terms at any time. Continued use of the Platform after any modification constitutes acceptance of the revised Terms.
The Operator shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond the Operator's reasonable control, including but not limited to natural disasters, pandemics, wars, civil unrest, government actions, power failures, internet outages, or telecommunications failures.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.
These Terms constitute the entire agreement between the Member and the Operator regarding the use of the Platform and supersede all prior agreements, understandings, and representations, whether written or oral.
